Terms and Conditions of Contract (Revised July 2009).

1. Really Easy Websites will create, host and maintain your website and associated services as instructed to us by the Client (you)
2. A first payment fee is required before we undertake any work. This is to cover remedial work necessary to host the site, including design. This fee covers all the design and set-up costs associated with getting your website ready for proofing.
3. The first quarterly payment is due once you are ready to have the site hosted. The site will not be Live and no email access will be granted until this first quarterly payment is made by you. There is no standard minimum term of contract for the pay-as-you-go packages. Thus your commitment is at most 3 months paid in advance. You can leave the service at anytime.
4. Within each package there are no limits to the number of changes that can be made to the site by yourself. If extra maintenance is required then this may be purchased for a nominal fee at any time. All request for Really Easy Websites to help with site maintenance should be requested via our contact form. We endeavour to contact you regarding pricing for our maintenace services within 48 hours via email.
5. This Pay-as-you-Go contract allows you to rent the website and the associated services from us for a quarterly fee. At no point in the contract does the copyright, website or the domain name become the property of you. Should you wish to purchase this at a later date then this can be arranged based on a market rate. All design and intellectual property will remain the property of Really Easy Websites. However, we will not sell or disseminate any property, domains or information to third parties unless we have contacted you and given you ample opportunity to purchase the rights first should such a need occur.
6. From time to time, new styles or other changes will be added to the main website. We endevour that these changes will not impact on your paid for site at any time, but we cannot be held responsible if they do. We will from time to time conduct maintenance on the servers that host your account, this is usually scheduled for out of hours and for short periods of time, however during these maintenance periods your website and email may be unavailiable.
7. If you wish to terminate your contract with us then please use the contact page on the main website. We will not refund any part of a pre-payment as we accept your payment for the period of the term specified (One quarter). A request to terminate will result in the site being removed and email access withdrawn when the last payment is exhausted.
8. If you should fail to pay on time then your service will be suspended until funds are made availiable. If your site is suspended, then there will be a £20 charge added to any outstanding charges to cover the engineer time and server costs of suspension and un-suspension of your account. Suspension of your account will entail loss of business and email communications for which we are not liable. If you fail to pay we will email you. Failure to have a response will invoke suspension of your account. At this time we will write to you asking what you would like to do, if we fail to receive contact then your site and all its information will be deleted after 7 days of this letter. Re-animation of a site once deleted will result in standard costs for a new site being applied.
9. We hold the right to terminate this contract without reason and without prior notice should the need arise this is without liability on our part and a binding term of this contract.
10. Quarterly payments must be made from a recognised UK bank account or UK credit card via our secure online or telephone facilities. Failure to make a quarterly payment on-time may result in your website being disabled and your email suspended. we are not liable for any costs involved in lost business or email as a result of these actions. Please call us if you are having difficulty - we are human too!
11. Our servers are very reliable. However, we are not liable for any loss of business or email resulting from server failure. We do have back-up devices and these help us maintain over 99% up-time. No host can guarantee 100% data integrity or online availability. Some issues are beyond our control.
